Welcome to SilverLeafPark ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at silverleafpark.sbs (the "Service") operated by SilverLeafPark.

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

SilverLeafPark offers elite yacht charter services, including:

  • Day yacht rentals
  • Sunset cruises
  • Business retreats
  • Exclusive gatherings
  • Extended charters

All services are offered based on availability and subject to weather conditions. We hold the authority to change or cancel services autonomously.

3. Booking and Reservations

3.1 Booking Process

To secure a charter, you must:

  • Have reached the age of majority, at least 18 years old
  • Submit accurate and thorough information
  • Make a deposit payment as indicated in your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is considered as confirmed only when a payment is made and confirmation is sent in writing by us. We maintain the right to deny service at our discretion.

3.3 Availability

All charters are reliant upon the availability of vessels and appropriate weather conditions. Efforts will be made to fulfill your preferred dates and hours for the charter.

4. Payment Terms

4.1 Pricing

Prices are presented in € and are inclusive of all relevant taxes unless declared otherwise. Price alterations may be made without prior notification.

4.2 Payment Schedule

  • Deposit: 50% of the full charter fee is due at the time of booking
  • Balance: Payable 48 hours before the charter commencement
  • Supplementary charges (if applicable): Payable after the charter is finished

4.3 Payment Methods

We accept major debit and credit cards, direct bank transactions, and verified cheques. Secure, encrypted channels are utilized for payment processing.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Greater than 72 hours prior to departure: Complete refund minus any transaction charges
  • Between 24-72 hours before departure: Half refund
  • Less than 24 hours before departure: No refund

5.2 Weather Cancellations

In the event that the weather is deemed unsafe for sailing by our captain, we will propose:

  • Rescheduling your charter at no extra charge to a new date
  • A full refund if rescheduling is unfeasible

5.3 Mechanical Issues

If there are mechanical problems with the assigned vessel, we will attempt to arrange a similar vessel. If a substitute is unavailable, we will offer a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are required to:

  • Adhere to instructions from the crew
  • Use provided safety gear when necessary
  • Disclose any medical issues that could impact safety
  • Stay within the designated areas onboard

6.2 Prohibited Items

Items not allowed aboard include:

  • Containers made of glass
  • Illegal substances
  • Firearms or any form of weapons
  • Excessive consumption drinks
  • Animals (unless approved beforehand)

6.3 Conduct

Passengers should conduct themselves respectfully. A charter may be terminated without refund if behavior endangers safety or hinders others' experiences.

7. Liability and Insurance

7.1 Our Liability

We limit our responsibility to the amount paid for the charter. We are not accountable for:

  • Injuries due to personal recklessness
  • Loss or damage to personal belongings
  • Indirect, accidental, or punitive losses
  • Delays from weather or situations out of our hands

7.2 Insurance Coverage

We carry comprehensive insurance for our fleet and operations. Travel and personal insurance is the responsibility of the passengers.

7.3 Assumption of Risk

Engaging in our charters implies acknowledgment of the risks involved in maritime activities and acceptance of personal responsibility for your safety and security.

8. Modifications and Itinerary Changes

We reserve the ability to alter travel plans, routes, or timings owing to weather conditions, safety reasons, or operational needs. Equal alternative experiences will be provided whenever feasible.

9. Force Majeure

Events beyond our direct control, including but not limited to the following, will not be our responsibility:

  • Extreme weather scenarios
  • Natural calamities
  • Government decrees
  • Port restrictions
  • Vessel malfunctions

10. Privacy and Data Protection

We handle your private information as per our Privacy Policy. By using our services, you agree to the collection and application of your data as stated in the Privacy Policy.

11. Intellectual Property

The content on our website, such as text, visuals, logos, and images, are under copyright and trademark law protection. Unauthorized reproduction, distribution, or creation of related works without our explicit consent is prohibited.

12. Governing Law

The governing laws of Monaco dictate these Terms. Disputes will be settled in the courts located in Monte Carlo, Monaco.

13. Changes to Terms

We retain the right to adjust these Terms at will. Revisions will be displayed on our website with the revision date updated. Continued service usage implies agreement with the modified terms.
